Last updated: 6 April 2025

These Terms & Conditions apply to all services, works, repairs, installations, maintenance, and quotations provided by Bay Breeze Air (“we”, “us”, “our”) to any customer (“you”, “your”). By accepting a quote, booking a job, paying a deposit, or allowing Bay Breeze Air to commence works, you agree to these Terms & Conditions.

1. Quotes & Pricing

1.1 Quoting Process

All quotations provided by Bay Breeze Air are based on the information available at the time of quoting. Quotes may be provided verbally, via text message, email, invoice system, or in writing.

1.2 GST (Important Pricing Information)

All Bay Breeze Air pricing and quotes are discussed and provided exclusive of GST unless specifically stated otherwise.

Bay Breeze Air is registered for GST, meaning GST will be added to all applicable invoices and charges.

1.3 Quote Validity

Quotes are valid for 30 days unless stated otherwise. Pricing may change after this period due to supplier pricing, availability, or job requirements.

1.4 Site Variables & Unexpected Conditions

The final cost may vary if conditions on-site differ from what was originally quoted, including (but not limited to):

  • restricted or unsafe access (ceiling spaces, roof access, tight spaces)
  • unexpected faults or pre-existing issues
  • non-compliant or unsafe wiring/pipework/previous installations
  • asbestos risk (Bay Breeze Air will not disturb asbestos materials)
  • weather delays or unsafe working conditions
  • changes required to meet Australian Standards

We will discuss any additional costs with you before proceeding.

2. Booking, Access & Job Attendance

2.1 Access Requirements

You must ensure we have safe and reasonable access to the site during the agreed booking window. This includes providing access to:

  • the indoor unit / ducted system / roof cavity (if required)
  • the outdoor condenser unit
  • switchboards and isolation switches
  • any locked areas, gates, pets, or security instructions

If our technicians cannot access the job site, a call-out fee may apply.

2.2 Missed Appointments

If you miss a booking or are unavailable at the time of attendance, you may be charged a missed appointment / call-out fee, especially if travel has occurred or the booking has been reserved.

2.3 Delays

Bay Breeze Air will always aim to arrive within your booking window. Sometimes delays occur due to:

  • emergencies
  • traffic or travel delays
  • supplier delays
  • unexpected job extensions prior to your appointment

We will do our best to keep you updated.

3. Variations (Changes to Agreed Works)

3.1 Variations After Acceptance (Key Requirement)

Once a job has been accepted (including approval to proceed, paying a deposit, or confirming a booking), any change to the agreed works becomes a variation.

This includes (but isn’t limited to):

  • adding extra work
  • changing equipment or scope
  • relocating units
  • upgrades to higher capacity systems
  • additional compliance requirements
  • additional labour or time needed due to new instructions

3.2 Variation Costs

Variations may result in:

  • additional labour charges
  • new material costs
  • additional travel or call-outs
  • increased overall job pricing

Bay Breeze Air will confirm variation pricing where practical before continuing.

4. Deposits & Payments

4.1 Deposits

A deposit may be required before:

  • ordering equipment
  • booking an installation
  • scheduling major works

Deposits confirm your booking and secure equipment allocation.

4.2 Payment Timeframes

Unless otherwise agreed in writing:

  • invoices are payable on completion
  • some works may require progress payments
  • equipment orders may require payment prior to delivery or installation

4.3 Overdue Payments

Overdue invoices may result in:

  • follow up notices
  • late fees or interest (where permitted)
  • suspension of ongoing work
  • debt recovery action, with costs recoverable from the customer

✅ 4.4 Ownership of Goods Until Paid (Retention of Title)

All equipment, materials, and goods supplied by Bay Breeze Air remain the property of Bay Breeze Air until payment is made in full.

If invoices are not paid, the outstanding amount may be referred to debt collection, which may result in recovery costs and/or a negative credit rating being applied against you.

5. Cancellations & Rescheduling

5.1 Customer Cancellations

If you cancel a job after we have:

  • booked labour
  • ordered materials
  • scheduled delivery
  • allocated equipment

you may be charged a cancellation fee and/or restocking fee.

5.2 Equipment Orders

If equipment has been ordered specifically for your job, cancellation may result in supplier restocking fees that are passed on to you.

6.1 Equipment Availability

Equipment availability depends on supplier stock levels. If an item becomes unavailable, we may offer:

  • a substitute product of similar specification
  • a revised quote

  • pause work until rectified
  • recommend additional works
  • require an updated quote before continuing
